Pedestrian Accidents

Pedestrians hit by a car should file a claim with the insurance company which insured the car. All cars, including out-of-state cars while driving in the Bronx, have at least the minimum $50,000 No-Fault coverage which will provide you with money to pay your medical bills, drugs and other medical expenses, household help and lost wages.

If the car was not insured, then you may file the claim with the insurer of a household family relative who had an auto policy at the time of the accident. If there was no auto policy in the household, you should file a claim with the Motor Vehicle Accident Indemnification Corporation (MVAIC).

Pedestrians struck by a motorcycle, should file a claim with the insurance company which insured the motorcycle. If the motorcycle was not insured, then you may file the claim with the insurer of a household family relative who had an auto policy at the time of the accident. If there was no auto policy in the household, you should file a claim with the Motor Vehicle Accident Indemnification Corporation (MVAIC).

You must submit written notice of claim to the No-Fault insurance company within 30 days of your accident; medical bills must be submitted within 45 days of the date of your accident; and lost wage claims must be submitted within 90 days.

In addition to a No-Fault claim for medical treatment and lost wages, you can also file a claim and lawsuit for pain and suffering against the owner and driver of the car which struck you.
